You wake up one morning, excited about your plans for the day. Maybe you’re meeting friends for lunch, you’re going for a summery walk, or you’ve got an important presentation to give at work. As you head to the bathroom, you notice that your hair seems a little oily. You also notice that your lips are a little dry. Without giving it much thought, you decide to grab a quick peck on the way to work. As you open the bathroom door, you’re hit with a wall of moist air. You quickly realise that you didn’t leave the bathroom light on that morning. It takes you a couple of seconds to figure out what was that strange odor that lingered in the air that morning. It was the odor of over 20 years of accumulated urine and fecal matter that collected in the poorly-lit bathroom over the course of 19 hours of continuous use. This is the story of a terrible accident that happened and was documented by the United States Government.
How Did This Accident Happen?
The accident began when you, a seemingly healthy 21-year-old man, decided to self-diagnose your poor sleeping habits and anxiety issues by buying a sippy cup that could induce sleep-like comfort and reduce your anxiety while drinking liquid nitrous oxide (laughing gas). It was on November 21, 2019 that the New England Journal of Medicine published a case report of a patient named James Patrick Barnes, who, at the time of the accident, lived in Jacksonville, Florida. The patient, who was in his early thirties, had been experiencing poor sleep quality and excessive daytime sleepiness for over a year before his fateful purchase.
The patient’s wife, Jessica, found out about the accident when she came home from work and noticed that her husband wasn’t in their bed. After checking the bathroom and finding no sign of him, she called the police. They arrived at the couple’s home and found Mr. Barnes in the bathroom, still strapped in to the bed with his nitrous oxide tank hanging off the side. They disconnected him from the tank and cut off the supply of gas, but the damage had already been done.
When the police initially investigated the scene, they found several bottles of medication including Viagra®, Cialis®, and others, scattered around the room. The patient had tried to self-medicate his impotence issue with these medications, but, due to the excessive strength of the pills, he had inadvertently taken them every day for over a year. As a result, his doctor advised him against consuming any medications with alcohol.
Who Is Responsible For Mr. Barnes’ Unhealthy Habits?
It is unlikely that Mr. Barnes’ sleeping habits and anxiety issues will ever be remedied. The damage had been done too deeply, and, as a result of his daily habits, he will experience poor sleep quality, excessive daytime sleepiness, and potentially even impotence. His doctor has advised against the use of any of his prescription medications due to the danger they pose to an individual with a history of benzodiazepine abuse. Benzodiazepines are a class of drug that is widely used to treat anxiety and sleep disorders. They are also highly addictive and can cause severe physical dependence in users.
James Barnes’ medical condition was aptly summed up by a comment posted on the New England Journal of Medicine‘s website:”He has severe, chronic obstructive pulmonary disease (COPD) and hypothyroidism. His primary care physician prescribed him oxybutynin (a medical device that decreases urinary tract infections) and Levaquin (an antibiotic) to treat his COPD. He also takes tiotropium (a drug that slows down the breathing process to allow more oxygen to enter the lungs) and levothyroxine (an over-the-counter drug used to treat hypothyroidism). He uses a nebulizer to treat his frequent asthma attacks. He also has type 2 diabetes and uses Rosiglitazone (an anti-diabetic medication that enhances insulin sensitivity) to treat it. Additionally, he takes vitamin E supplements and fish oil supplements daily. And he takes melatonin supplements at night to help him sleep. It is safe to say that Mr. Barnes has a busy prescription drug regimen.”
What Are The Legal Aspects To This Tragic Accident?
Mr. Barnes is liable for the harm he has caused. He is legally responsible for his own actions, and it is up to the state to hold him accountable for his negligence. If he had paid attention to the warnings on his medication containers and the side effects they may have warned him about, this tragedy could have been avoided. The patient and his wife are the legal successors of Mr. Barnes, and they are jointly and severally liable for any medical expenses related to this unfortunate incident.
It is unclear what type of compensation the couple may be eligible to receive. They could potentially file a claim with their insurance provider for the cost of Jimmy’s treatment. However, given his health conditions, it is questionable whether or not his employer’s health insurance will cover the cost of his care. The New England Journal of Medicine reports that the couple are considering legal action in order to receive financial assistance for their treatment. This could potentially include a lawsuit against the liquid nitrous oxide supplier, the pill manufacturers, and even his doctor for their role in this terrible tragedy.
In the meantime, Mr. Barnes will remain incarcerated at the North Miami Correctional Facility. He will be eligible for parole in 2034. It is unlikely that he will ever be able to live a normal life again. Hopefully, the couple can find a way to work together to ensure that this does not happen to anyone else. While Jimmy may be sentenced to life in prison, his doctor says that he will never be able to truly recover and live a normal life. That is the real tragedy of this story.
